HIPPA Notice of Privacy

THIS NOTICE DESCRIBES HOW MEDICAL AND DENTAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Your Ownership Rights Under New Hampshire Law

Under New Hampshire RSA 332-I:1, your dental and medical records are explicitly designated as your legal property. While our practice maintains the physical or electronic systems containing this data, you retain complete legal ownership of your health information.

How We May Use and Disclose Your Health Information

We may use and disclose your Protected Health Information (PHI) for the following core purposes:

  • Treatment: To coordinate, manage, or provide your dental care across hygienists, specialists (e.g., endodontists, oral surgeons), labs, or other healthcare providers.

  • Payment: To bill and collect payment from you, your dental insurance carrier, or third-party payers.

  • Healthcare Operations: To support quality assurance, clinical audits, staff training, and internal management.

  • Appointment Reminders & Service Updates: To contact you via phone, text message, email, or mail regarding upcoming visits, care options, or health-related benefits.

Additional Disclosures & State Restrictions

  • Health Information Exchange (HIE) Opt-Out: If our practice participates in a state or regional Health Information Exchange to share electronic records, you have the right under NH RSA 332-I:3 to opt out of having your health information shared through the exchange.

  • Legal & Public Health Disclosures: We may share PHI without consent when required by law for public health safety, abuse reporting, court orders, workers’ compensation claims, or law enforcement needs.

  • Written Authorization Required: We will never sell your PHI or use it for marketing purposes without your explicit written permission.

Your Expanded Patient Rights (HIPAA & NH RSA Chapter 332-I)

As a dental patient in New Hampshire, you hold the following statutory rights regarding your health records:

  • Right to Inspect and Receive Copies: You may inspect or request paper/electronic copies of your dental and billing records. Under New Hampshire law:

    • Your request must be fulfilled within 30 days. If we fail to deliver records within 30 days, they will be provided at zero charge.

    • Direct transfers to another healthcare provider will be completed within 14 days at no charge.

    • Fees for electronic records are capped at a maximum of $50.00. Paper copies are capped at $5.00 for the first page plus statutory per-page fees thereafter.

  • Right to Electronic Access Audit Trails: Under NH RSA 332-I, you have the right to request an audit trail report showing every individual who has accessed your electronic health records over the preceding 3 years.

  • Right to Request Restrictions: You may request restrictions on how PHI is shared. If you pay for a procedure out-of-pocket in full, we must honor your request not to share those treatment details with your health insurer.

  • Right to Amend Records: You may submit a written request to correct inaccurate or incomplete health records.

  • Right to Confidential Communications & Accounting of Disclosures: You may request to be contacted via alternative addresses/phone numbers and request a 6-year history of non-routine PHI disclosures.
